TERMS & CONDITIONS

The Tour Operator

Store Norske Gruve 3 AS (hereinafter referred to as the tour operator) is responsible for guided tours of Gruve 3 as further specified below. Unless otherwise agreed, this will be the current agreement between Store Norske Gruve 3 AS and the customer who orders guided tours / venue hire.

 

Reservations

Reservations must be done via the tour operator’s online booking system or in writing via email. A reservation is binding when the orderer has received written confirmation; the terms and conditions will then apply unless immediate written notice is given to the tour operator of mistakes or errors in the reservation.

The tour operator has an age limit for guided tours of the facility/mine. Children younger than 12 years old are therefore not permitted participation.

 

Payments

For individual reservations, the full amount must be paid in full when booking.

An invoice for group reservations is issued when the guided tour is completed and at the beginning of the following month. Payment is due 14 days from the invoice date. An

extra fee must be added for a notice/reminder for late payments. In the event of missing payment on notice, the claim will be sent to an external creditor.

For issuing of invoices, name, address, and email are required, as well as a Norwegian Organisational Number or National Identity Number. The customer may also choose to pay the full amount when making a group reservation.

The tour operator does not offer invoices to non-Norwegian customers without a Norwegian Organisational Number / National Identity Number. The reservation must therefore be paid in full when booking.

 

Amending a Reservation

Reservations may be amended and moved to another time free of charge, if there is availability on the requested time. In case of changes/rebooking, the ordinary reservation will be valid regarding cancellations.

Payments/reservations will not be refunded in case of cancelled flights or changes in flight plans to Svalbard. Store Norske Gruve 3 AS cannot be held liable for the potential loss of funds due to changes in currency exchange rates or transaction fees which apply in cases of funds being transferred internationally when a payment/reservation is refunded.

 

Cancellation

Cancellation of individual reservations (1-9 participants)

Individual reservations mean a single booking of 9 people or less reserved online, e.g., via gruve3.no or visitsvalbad.com. Cancellations must be made in writing.

 

The following cancellation fees apply for individual reservations:

-     Up to 22 days before the activity: 5% of the amount paid

-     From 21—8 days before the activity: 50% of the amount paid

-     Later than 8 days before the activity or no-show: no refund

Cancellation of group reservations (10 or more participants)

Group reservations mean a single booking for at least 10 participants or more reserved directly with the tour operator. Cancellations must be made in writing.

The following cancellation fees apply for group reservations:

-     Up to 120 days before the activity: no charges

-     From 120—60 days before the activity: 50% charge

-     Later than 60 days before the activity and no-show: 100% charge

 

Reduction in the number of participants for group reservations:

Up to 2 weeks prior to the event, the number of participants in group reservations can be changed up 20%. If the number is reduced later than 2 weeks prior to the event, the full amount will be charged.

 

The Customer’s Obligations

The customer is obliged to, and responsible for, familiarising themselves with the terms and conditions and participation for the tour or venue hire booked, and to convey this information to other participants they have booked on behalf of. Furthermore, the customer and any other participants are obliged to follow any instructions given by the tour operator and/or its tour guides. The customer is also obliged to familiarise themselves with the current rules and regulations for travel to Norway and Svalbard.

 

The Customer’s Responsibilities

The customer and the other participants are responsible for assessing their physical and/or mental shape in relation to the content of the tour, preferably prior to booking the activity.

Store Norske Gruve 3 AS may not be held liable for any accidents and injuries that are beyond their control. The tour operator reserves the right to refuse participation in an activity if the customer, and/or any other participants they have booked on behalf of, is regarded as a threat to their own safety or the safety of the other participants, or if the customer/participant behaves in such a way that one is a major nuisance to the other tour participants. If the tour is delayed, changed or cancelled due to one or more of the participants not following the tour operator’s instructions, the participant(s) concerned may be held financially liable for any additional costs incurred.

 

Insurance

Store Norske Gruve 3 AS is insured for liability through its own insurance company and covers damage to third parties in relation to guided tours and events in Gruve 3, and related areas out in the open. The tour operator has also provided the necessary security to the Governor of Svalbard. This covers expenses in relation to any rescue operations, among other things.

The customer, and any other participants they have booked on behalf of, is recommended to take out travel insurance. Each customer/participant has a personal responsibility to ensure that such travel insurance has been taken out prior to participating in the activity.

 

Changes to the Itinerary / Unforeseen Circumstances

The tour operator reserves the right to change departure times or cancel tours up until the scheduled starting time of the tour where the minimum number of participants for the tour has not been met. Should a cancellation occur where the minimum number of participants has not been met, the refund will be limited to the amount paid to the tour operator.

Likewise, the tour operator reserves the right to cancel tours up until the scheduled starting time due to weather and snow conditions, force majeure or other circumstances beyond the tour operator’s control, which prevent the activity from being implemented in a safe manner. In cases where it is necessary to make changes to the content of the activity due to unforeseen circumstances/weather conditions, this will not affect the price of the activity.
